Knowing your rights gives you power. These rights apply in most countries โ always confirm with a local legal advisor or helpline for your specific situation.
๐ Right to Stay in Your Home
In Ireland and the UK, you generally have the right to remain in the family home even if you are not the owner. A court can order the abuser to leave. You do not have to be the one to go. Contact a solicitor or domestic violence helpline for advice specific to your situation.
๐ Safety Orders and Barring Orders
Ireland: You can apply for a Safety Order, Protection Order, or Barring Order through your local District Court. This can be done without a solicitor. The court can order the abuser to stop the behaviour or leave the home. UK: Non-Molestation Orders and Occupation Orders provide similar protection.
๐ถ Rights Regarding Children
You have the right to take your children to safety. Leaving with your children is not kidnapping if you are acting to protect them. Courts prioritise children's safety. Document any incidents involving or witnessed by children โ this strengthens your case in any custody proceedings.
๐ฐ Financial Rights
Financial abuse is recognised in law in Ireland and the UK. You have the right to access marital finances. You may be entitled to emergency financial assistance from your local council or welfare office. Open your own bank account โ you are legally entitled to do this.
๐ฑ Evidence You Can Collect
Keep copies of threatening messages (screenshot and send to a trusted email). Take photos of any injuries โ date-stamped. Write a diary of incidents with dates and details. Keep medical records of any treatment for injuries. This evidence can be crucial in court proceedings.
๐ If You Are a Migrant
Your immigration status does not affect your right to protection from abuse. Domestic violence helplines can advise on your rights regardless of immigration status. In Ireland, Ruhama (ruhama.ie) and Migrants Rights Centre Ireland (mrci.ie) offer specific support. In the UK, contact Southall Black Sisters (southallblacksisters.org.uk).
